Protection of Personal Data
Since the protection of your personal data is important to our company, we hereby provide the following information regarding the processing of personal data.
We process your personal data exclusively in accordance with the Regulation of the European Parliament and Council (EU) No. 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) and Act No. 18/2018 Coll. on the protection of personal data and on amendments to certain laws (hereinafter referred to as the “Data Protection Act”):
Explanation of basic terms you may encounter:
- Controller – any natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data and processes personal data in their own name.
- Processor – any natural or legal person who processes personal data on behalf of the controller based on authorization or a contract.
- Data Subject – any natural person whose personal data is being processed.
- Personal Data – any data or information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to a generally used identifier, another identifier such as a name, identification number, location data, online identifier, or by reference to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
- Recipient – a natural or legal person, public authority, agency or other body to which personal data is disclosed, including a processor.
- Purpose of Processing – a clearly defined or legally established intention for processing personal data, linked to a particular activity.
- Processing of Personal Data – any operation or set of operations performed on personal data, such as collection, recording, organization, modification or correction, retrieval, viewing, use, restriction, provision, disclosure, cross-border transfer, storage, deletion, or destruction, regardless of whether performed by automated, semi-automated or non-automated means.
- Consent of the Data Subject – any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which they, by a statement or by a clear affirmative action, signify agreement to the processing of personal data relating to them.

These data processing principles apply to the following data subjects:
- Persons we assist in finding employment
- Our employees who are temporarily assigned to work for another user employer
- Our suppliers (natural persons) who perform tasks assigned by our business partners
- Users of our website balax.eu
- Representatives of our business partners
- Natural persons who have contacted us through our contact form with a question, request, or suggestion
The purpose of processing your personal data is mainly:
- Mutual cooperation and provision of services to job applicants, employers, suppliers, and potential other entities
- Accessing and using the website balax.eu
- Communication with job applicants
- Communication with potential suppliers or contractual partners
The specific activities of our company that involve the processing of personal data, as well as details concerning the processing of these personal data (i.e., purposes of processing, legal basis, categories of data subjects, and recipients), are described in the annex “Records of Processing Activities.”
Your personal data are not processed for any purpose other than the one for which they were originally obtained, unless a specific regulation under which our Company operates provides otherwise or unless the data subject gives voluntary and explicit consent.
The legal bases on which we process personal data include the following:
- Specific Regulations
This includes, for example, fulfilling notification obligations to public authorities (e.g., social insurance, tax office, etc.), fulfilling obligations related to enforcement of decisions, fulfilling archiving obligations, resolving disputes, particularly for the purposes of litigation or other legal proceedings, etc. - Conclusion and Fulfillment of Contracts or within Pre-contractual Relationships Based on Requests from the Data Subject
- Explicit Consent of the Data Subject
Consent of the data subject is obtained only if no other legal basis for processing personal data without consent applies. Providing personal data and granting consent in such cases is voluntary. If personal data are processed based on consent, the data subject has the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. For example, this includes situations where personal data are processed for the purpose of potentially contacting the data subject with a new job offer after the conclusion of a selection process in which they participated, or other relevant job offers. - Legitimate Interest

We may collect your personal data in various ways, such as through the website; social media channels; by phone, email, or mail; during face-to-face meetings related to job placement or the establishment of a mutual contractual relationship; or in connection with interactions with business partners and clients.
Personal data is obtained by our company directly from the concerned individuals or from other persons and authorities in accordance with GDPR, the Data Protection Act, and specific regulations to the extent necessary under these regulations to achieve the purpose of processing.
As concerned individuals, you are required to provide your personal data if it involves the processing of personal data resulting from specific regulations (fulfillment of legal obligations). Similarly, this procedure is followed in the case of concluding a contractual relationship with the concerned individual. If personal data is not provided, it would not be possible to fulfill legal obligations or establish a contractual relationship.
Our company, as the Controller, will process your personal data only to the necessary extent, particularly the following personal data:
Personal data collected when sending a candidate’s resume: title, first name, last name, email address, phone number, resume, and all personal and other information contained in the resume.- Personal data collected when requesting a quote: title, first name, last name, company name, job position, email address, phone number, or other information that the potential contract partner voluntarily provides in their request.
- Personal data collected when submitting a contact form: name, email address, phone number (if not filled in, it will not be possible to submit the contact form), and possibly other personal data that the concerned person voluntarily provides in the message of the contact form.
- Login data collected when logging in and using our website www.balax.eu.
Our website allows you access to various services of our Company, such as job offers, business cooperation, and information about the job market.

Cookies are small text files stored on the user’s computer for recording purposes. These files are a tool to improve the ergonomic design of the website, create a user-friendly website, and enhance the visitor experience. Your personal data may be provided to external companies that assist us with various activities involving the processing of personal data (business partner for whom you are performing certain work or activities, accounting, IT services, marketing services, legal services, etc.). Your personal data may also be provided to potential employers. Personal data is provided to third parties only when all conditions arising from the relevant legal regulations concerning personal data protection are met. Your personal data may be provided to entities within the European Union or to countries outside the European Union. In any case, when your personal data is provided, our Company will take all necessary measures to ensure the protection of all your personal data.
Our company does not engage in processing personal data based on automated individual decision-making, does not conduct profiling, and also does not provide information society services pursuant to Article 8(1) of the GDPR and § 15(1) of the Personal Data Protection Act.
Our Company processes personal data only for the period necessary to achieve the purpose of their processing. Additionally, we note that our Company continuously assesses and evaluates the need to process certain personal data for a specific purpose. Assuming we find that some personal data are no longer necessary for any of the stated purposes for which they were processed, we will promptly dispose of this personal data.
For the purpose of fulfilling legal obligations, personal data are processed for the period specified by the relevant legislation (accounting documents are processed for 10 years, other documents – such as those arising from employment relationships – for their statutory archiving period – for further information, please refer to the Appendix – Records of Processing Activities).
Personal data processed by our Company for the purpose of fulfilling contractual relationships and for taking measures prior to the conclusion of a contract at the request of the data subject are processed for a period of 5 years from the termination of the contractual relationship concluded with the data subject.
For the purposes of protecting the legitimate interests of our Company, we process your personal data for the duration of this legitimate interest, provided that there is no event that results in the earlier termination of this processing of personal data (e.g., objection to the processing of personal data for direct marketing purposes, etc.). For the protection of our rights in potential legal disputes, our Company typically retains your personal data for a period of 3 years (in the case of a contractual relationship concluded under the provisions of the Civil Code) or for a period of 4 years (in the case of a contractual relationship concluded under the provisions of the Commercial Code) from the moment our claims may be first asserted in the relevant court.
Our company has implemented all appropriate technical and organizational measures to secure your personal data. We have also taken all necessary technical measures to secure data storage of personal data in paper form. At the same time, in this context, we state that only verified and authorized persons who are duly informed and committed to complying with the protection of personal data have access to your personal data.
In accordance with Articles 15 to 22 of the GDPR and Sections 21 to 28 of the Personal Data Protection Act, you, as a data subject, generally have the following rights:
- The right to confirmation of the processing of personal data.
- The right to access personal data.
- The right to rectify personal data.
- The right to erasure of personal data.
- The right to restriction of processing of personal data.
- The right to data portability.
- The right to object to the processing of personal data.
- The right not to be subject to a decision based solely on automated processing, including profiling.
Right to confirmation and access to personal data
You have the right to request a copy of the personal data we hold about you, as well as information on how we use your personal data. In most cases, your personal data will be provided to you in writing, unless you request another method of provision. If you have requested this information electronically, it will be provided to you electronically, where technically feasible.
Right to rectification of personal data
We take appropriate measures to ensure the accuracy, completeness, and timeliness of the information we hold about you. If you believe that the data we hold is inaccurate, incomplete, or out-of-date, please do not hesitate to ask us to correct, update, or supplement this information.
Right to erasure (right to be forgotten) of personal data
You have the right to request the deletion of your personal data if: a) they are no longer necessary for the purposes for which they were collected and/or processed, b) you withdraw your consent to the processing of personal data and there is no other legal basis for processing, c) you object to the processing of personal data based on legitimate interest, and your interests, rights, and freedoms do not override our legitimate interests, or you object to processing for direct marketing purposes, d) personal data are processed unlawfully, e) the reason for deletion is to fulfill a legal obligation under the law, a special regulation, or an international treaty to which the Slovak Republic is bound.
However, your right needs to be assessed in light of all relevant circumstances. For example, we may have certain legal and regulatory obligations, which means we may not be able to comply with your request.
The obligation to erase personal data does not apply if there is an exception under Article 17 (3) of the GDPR or § 23 (4) of the Personal Data Protection Act.
Right to Restrict Processing of Personal Data
Under certain circumstances, you have the right to ask us to stop using your personal data. This includes cases where you believe that the personal data we hold about you may be inaccurate or when you believe that we no longer need to use your personal data.
Right to Data Portability
Under certain circumstances, you have the right to request the transfer of personal data that you have provided to us to another third party of your choice. However, the right to data portability only applies to personal data that we have obtained from you based on consent or on a contract to which you are one of the contracting parties.
The possibility of portability will be individually assessed in each case.
Exercising the right to data portability on your part must also not have adverse effects on the rights of other individuals.
Right to Object to Processing of Personal Data
You have the right to object to the processing of data that is based on our legitimate interests. If we do not have compelling legitimate reasons for processing, and you object, we will not further process your personal data.
The right to object to the processing of personal data does not apply if the personal data is processed for scientific purposes, historical research purposes, or statistical purposes.
Right Not to be Subject to Automated Individual Decision-Making, Including Profiling
The right not to be subject to automated individual decision-making, including profiling, does not apply in our conditions; our Company does not carry out processing based on automated individual decision-making and does not carry out profiling.
Method of Exercising Your Rights

If legitimate doubts arise about your identity when exercising your rights, our Company is, in accordance with applicable law, entitled to verify your identity, for example, by requesting additional information, summoning you, if necessary, and verifying your identity document or by other suitable means.
Contact with the supervisory authority
If you believe that your rights regarding the processing of personal data have been violated, you have the right to lodge a complaint or propose the initiation of proceedings in accordance with the Personal Data Protection Act, to the leading supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27, tel. no.: +421/2/ 3231 3214, email: statny.dozor@pdp.gov, https: //dataprotection.gov.sk In the case of submitting a proposal electronically, it is necessary to meet the requirements according to § 19 para. 1 of Act No. 71/1967 Coll. on administrative proceedings (administrative procedure).
